According to Article 45 of the Competition Law 2018, the following behaviors are considered unhealthy competition and are prohibited:
[1] Violating trade secrets in the following ways:
- Accessing and collecting trade secrets by circumventing the security measures of the information owner;
- Disclosing or using trade secrets without permission from the information owner.
[2] Coercing customers or business partners of another enterprise through threats or force to prevent them from transacting or ceasing transactions with that enterprise.
[3] Providing dishonest information about other businesses by directly or indirectly spreading false information about the business that negatively impacts its reputation, financial status, or operations.
[4] Disrupt the business operations of another enterprise by directly or indirectly impeding or interrupting its lawful business activities.
[5] Attract customers through dishonest means, using the following methods:
- Provide false information or create confusion for customers about the enterprise, products, services, promotions, or transaction terms related to the goods and services provided by another enterprise in order to attract customers from that enterprise.
- Compare one's own goods or services with similar goods or services from another enterprise without providing evidence of the content.
[6] Selling goods, providing services below the cost price may result in or have the potential to eliminate other businesses that sell the same goods or services.
[7] Other anti-competitive behaviors which are prohibited under other laws.
